Terms & Conditions 

These are the terms & conditions that apply for playing on Vycto's platform ! 🏆

We know it’s tempting to skip these Terms of Service and go straight to having fun on our platform, but it’s important to establish what you can expect from us and what we expect from you

These Terms of Service (“Terms”) are a binding legal agreement between you and “Vycto” that govern your right to use the websites, applications, and other offerings from Vycto Entertainment Technologies (collectively, the “Vycto Platform”). The terms “we”, “us” or “our” shall refer to Vycto. The terms “you”, “your”, “User” or “customer” shall refer to any individual or entity who accepts this Agreement, has access to your account or uses the Service.

 

Eligibility and entry restrictions

  • 1.1 Users must comply with all requirements for entry specified in “Rules” of the relevant challenge

  • 1.2 All users of vycto.com may participate in the Giveaway provided that they are adults over the age of 18. Those who have not completed the 18th year may take part in the Giveaway, however, a minor under the age of 18 can accept the gift provided that they have the consent of a parent or guardian.   • 1.3 The maximum number of entries to a competition per person is 1.

  • 1.4 Competition entrants for our promotions on social media must have an active genuine account. Multiple entries from the same person will be disqualified.

  • 1.5 Users may not use usernames that are deemed abusive, profane, threatening, offensive. Contestants that do so will be removed from the competition.

  • 1.6 Our competitions are free to enter (no purchase required).

  • 1.7 Promotions on social media are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram, LinkedIn or any other social network. You are providing your information to Vycto Entertainment Technologies and not to any other party. The information provided will be used in line with our Privacy Policy.

  • 1.8 We reserve the right to cancel or amend the competition and these terms and conditions in the event of a catastrophe, war, civil or military disturbance, any actual or anticipated breach of any applicable law or regulation or any other event outside of our control. Any changes to the competition will be notified to entrants as soon as possible by us.

 

Winners and prizes

  • 2.1 The winners will be selected based on the ‘Vycto Leaderboard’ which is calculated based off of the points indicated next to each question in the Challenge Questionnaire.

    • The calculated leaderboard can be found on https://vycto.com/search-leaderboard. If the winners of the competition fail the verification check and do not follow the requirements (e.g. Follow the Instagram + Tag 2 Friends) after winning, they will be denied the prize of the competition; this decision is irreversible. The winners will also be contacted via email and social media given that it has been provided on their Vycto account and they have followed all requirements of the challenge. Winners will be given full details as to how they can claim their prize.

  • 2.2 Players may opt for ‘lower-ranked’ prizes if they choose to do so (Eg: 1st place opt for 2nd-place prize → 2nd place will then get 1st place prize or opt for ‘lower-ranked prize’).

  • 2.3 Reasonable efforts will be made to contact the prize winner for 3 days but if the winner fails to respond to our notification attempts within this time, or provide an address for delivery of the prize, or fails to meet any of the eligibility requirements, or is otherwise unable to comply with the competition terms and conditions, no liability shall lie with the organising company for not delivering the prize. In cases where the winner cannot be located in time due to incorrect information which the user themself declared when the account was created, we reserve the right to disqualify that entrant and offer the prize to the next runner-up on the leaderboard and thereafter until a winner is found.

  • 2.4 If you have won a “Predict & Win contest”, your full name, email, and social ID will be shared with sponsors of the competition so that they can contact you for delivery of prize, or for specificities regarding social media campaigns (e.g Announcing winner on Instagram Story).

  • 2.5 No cash alternative to the prizes will be offered. The prizes are not transferable.

 

 

Withdrawal of Notice – Amendment of Terms

  • 3.1 We reserve the right to cancel the Competition or modify its terms (including the duration of the Competition, the date of the draw and replace the Prize), by informing about this change through Facebook and Instagram channels. We do not assume any responsibility or liability in the event of revocation or termination of the competition or in respect of the modification of any of the competition’s terms and conditions or the replacement of the prize.

 

Copyright and moral rights

  • 4.1 You warrant to us that you created your competition entries, that you own all of the copyright in those entries, and that our use of the entries in accordance with these rules will not infringe any person’s intellectual property rights or other legal rights.

  • 4.2 You grant to us an exclusive, worldwide, royalty-free, perpetual and irrevocable licence to copy, store, edit, distribute, transmit and publish your competition entries. Competition entries will be publicly visible on leaderboards once the event starts under section “View Prediction”.

  • 4.3 By participating in a contest each participant accepts that their personal information has been collected and used by the organiser for processing by automated or non-automated means either by itself or by any other person appointed by the Organiser to carry out such processing under mandate and for its account under this Agreement. The personal details of the winner in the Giveaway, in their capacity as such, will be retained by the Organiser and used exclusively for the purposes of the Giveaway. In any case, the participants’ personal data will be kept in accordance with the General Regulation on the Protection of PersonalData – Regulation (EU) 2016/679 of the European Parliament (GDPR).

 

Publicity

  • 5.1 We may undertake publicity activities relating to competitions and prize awards. The winner therefore agrees to the use of their name, photograph and disclosure of town or region of residence in any post-prize-winning publicity names, surnames, towns or regions of residence and prize details. The advertising activity in question is not limited only to the use of the names of the winners but may also include the use of a picture through photography or filming with the protagonists of the Competition. The Company intends to request your consent for the use of images and photographs.

  • 5.2 All other personal details collected as part of the competition will be used in line with our Privacy Policy.

 

Creation of Competitions (User Generated Content, UGC)

  • 6.1 You are responsible for all content such as text, data, images, image series (hereinafter "content") that you transmit toward Vycto for the creation of a contest. With submission of content you affirm that you own the user rights to publish this content on the internet. Furthermore you guarantee that the submitted content is not encumbered by the rights of third parties. Vycto reserves the right to check the content in individual cases.

  • 6.2 It is within your responsibility to make sure the transmitted content is lawful, does especially not violate applicable law or rights of third parties. You are particularly obligated towards Vycto to make sure that the transmitted content does not violate penal provisions, copyright, competition law, youth protection acts, trademarks and other commercial property rights as well as personal rights of third parties.

  • 6.3 If there is tangible indication that content submitted by you and/or usage of services violate statutory regulations, third party rights or these T&C are other good causes, Vycto may delete the transmitted content, limit your user rights, issue a warning or ban your account temporarily or permanently. When choosing such measures, Vycto will take your legitimate interest into account.

  • 6.4 Your use of the Site and all Content you posted on, transmitted through, or linked from the Site is in compliance with the rules set forth in these Terms and all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all export control laws.

  • 6.5 You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other user's use and enjoyment of the Site. You may not upload, publish, post, distribute or disseminate any content that defames, abuses, harasses, stalks, threatens or otherwise violates the legal rights (such as rights of privacy and publicity) of others. You may not upload, publish, post, distribute or disseminate any files that contain viruses, malware, malicious codes, corrupted files, or any other similar software or programs that may damage the operation of another's computer.

  • 6.6 You may not upload, publish, post, distribute or disseminate any Content that is used for unlawful purposes or for the promotion of dangerous and illegal activities. You may not upload, publish post, distribute or disseminate any Content that is otherwise deemed as pornographic and/or obscene by Vycto. This includes, but is not limited to, commercial pornography, pedophilia, incest, bestiality, child pornography, or anything similar that violates any applicable laws. Vycto will report any evidence of dangerous and illegal activites along with all known user identification and information to the relevant law enforcement agencies.

  • 6.7 You may not upload, publish, post, distribute or disseminate any Content that promotes hatred towards groups based on race or ethnic origin, religion, disability, gender, age, and sexual orientation/gender identity.

  • 6.8 You may not upload, publish, post, distribute or disseminate any Content that impersonates or is intended to impersonate others in a manner that is intended to mislead or does mislead or confuse others. You may not use affiliate links to third party sellers who have not approved you into their affiliate programs.

  • 6.9 You may not use the Site to harvest or otherwise collect information about others, including e-mail addresses, without their consent. You may not upload, publish, post, distribute or disseminate any unauthorized private, confidential and personal information about others.

  • 6.11 You may not rely on the Content, and that under no circumstances will Vycto be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Site.

Notices and Procedure for Making Claims of Copyright Infringement

  • If you believe that anything on the Site infringes upon any copyright which you own or control, you may file a notification of such infringement

  • To be effective, the notification must be a written communication that includes the following:

    • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

    • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material

    • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted;

    • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and

    • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    • We may give notice of a claim of copyright infringement to our users by means of a general notice on the Site, electronic mail to a user's email address in our records, or by written communication sent by first-class mail to a user's address in our records.

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, Vycto has adopted a policy of terminating, in appropriate circumstances and at the sole discretion of Vycto, account holders who are deemed to be repeat infringers. Vycto may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
